A vital document in these cases is the Escritura or the Deeds Certificate and it is the duty of the legal expert to obtain this certificate which is a proof of the fact that the property is available fro purchasing.
This is followed by negotiations between the prospective buyer and the mortgage provider regarding the conditions of repayment and all these are noted down in the form of a Contrato de Promessa de Compra e Venda or a Contract for Sale and all the necessary decisions undertaken are done in the presence of the lawyer who is to prepare this contract. In case the buyer is no more interested in buying the property, he loses the deposit. If the seller withdraws, because of the terms in the contract he will be forced to reimburse twice the amount taken as deposit. The property tax and the stamp duty tax also have to be paid in time. Before the final submission of documents for land registry, both parties will conclude the Transfer of Title Deeds by means of which the ownership is transferred to the new owner.
